Photography

Mark Arts encourages photography while protecting the intellectual property of our artists. Works of art owned by or on display at Mark Arts may be protected by copyright not held by Mark Arts. Please review the photography policies below before photographing artwork.

Personal Photography

Mark Arts defines personal photography as all wedding, engagement, prom, quinceañera, family, maternity, portfolio, graduation, and any other posed portraiture of individuals by professional photographers, as well as semi-pro, pro-am, or amateur photographers, whether the photographer is being paid or not. Personal photography is allowed in Mark Arts, but Mark Arts assumes no responsibility for any royalties or fees claimed by the artist or on the artist’s behalf by representatives. In some instances, photography is prohibited due to contractual arrangements and copyright protections. Galleries where personal photography is not permitted will be marked with signage. Flashes, tripods, and other equipment are prohibited in the galleries without prior approval from Mark Arts Gallery Director. Mark Arts requests that images of artwork credit the artist.

Commercial Photography

Commercial photography is not permitted in any area of Mark Arts without pre-approval. Requests must be approved by the Gallery Director; commercial photography requests should be emailed to the Gallery Director at least two weeks in advance. A Mark Arts staff member must be present during the photography session.

High School Students and Large Group Photography

The Mark Arts galleries and sculpture garden make the perfect photo backdrop for prom photos and other celebrations. During prom season, Mark Arts keeps the galleries open late for high school students to utilize for group photos. Please check our events calendar for extended gallery hours. Please note that all trash must be thrown away, and no weapons, helium balloons, confetti, glitter, or candles are allowed on our campus.

Photography sessions outside of traditional business hours must be scheduled in advance with the Marketing Manager. Photography must not disrupt visitors or private events or limit access of doorways, entrances, and exits. Please do not touch any artwork on Mark Arts property. Please do not climb or stand on pieces in the Sculpture Garden. No props may be placed within four feet of artworks and pedestals. Care must be taken at all times to protect the works of art. If at any time the Mark Arts staff determines a work is in danger, the photographer may be asked to stop the photo session.

Tobacco Use

Smoking is prohibited within 25 feet of the facility to provide a safe environment for all visitors. Smoking is permitted outside of the building and must be more than 25 feet from a door opening. Smoking receptacles are provided on the Gallery and Great Hall Terraces.

Weapons

Mark Arts prohibits visitors from bringing any firearms or other weapons, including but not limited to ammunition and explosives. This policy does not apply to law enforcement officers, government or military authorities or their agents acting in their official capacities.

Anti-Harrassment Policy

Mark Arts is committed to providing an environment that is free of harassment. Harassment in any form will not be tolerated. If a visitor is disruptive, they will be asked to leave Mark Arts with no refund issued for class or workshop registration fees.

Mark Arts creates and disseminates digital images of its study collection for scholars, nonprofit organizations and businesses. The fees are in general alignment with standard costs for similar services in the museum profession. Mark Arts makes no representation that it is the owner of copyright on images from the study collection and assumes no responsibility for claims by artists or artist representatives. Mark Arts will not request copyright permission to reproduce the work on behalf of external entities.
